Mortgage path

When keeping, splitting, or replacing the house requires a new loan.

This path is for people who will likely need a purchase or refinance — before the divorce, in the middle of it, or after the decree. Joe will still tell you if an assumption or a consult is the better first step.

Buy a home after divorce

The next household often needs a different house than the last one. Qualification is not the same as it was on a joint application: income that continues, child support that can be counted, remaining joint debts, and the timing of the decree all matter. Joe works this regularly along the Front Range and will say plainly whether you can purchase now or should wait until a specific document is in hand.

Refinance to remove a spouse from the mortgage

Courts can award the house. They cannot rewrite the loan contract. If both names are on the mortgage, both remain liable until a lender completes a refinance or, when allowed, an assumption. A quitclaim deed changes title; it does not take someone off the debt. If your goal is to be the only person on the loan — or to be free of it — this is the conversation to have before the other person is told “you’re off the mortgage.”

Refinance to fund a marital equity buyout

A buyout refinance pays off the current loan and, when equity and qualifying allow, puts cash to the departing spouse as required by the settlement. The remaining borrower has to qualify on their own. Running those numbers early is how families avoid agreeing to keep a house they cannot actually finance. Joe will look at payment, cash to close, and whether a different structure (sale, assumption, or delayed refinance) is more honest.
